Québec wrote a paid repair technician into statute, and nobody read it that way. The clock starts 5 October 2026.
Décret 1459-2025, published in the Gazette officielle du Québec on 17 December 2025, inserts section 79.21 into the Règlement d’application de la Loi sur la protection du consommateur. From 5 October 2026 every stove, fridge, freezer, air conditioner and heat pump sold in Québec carries a six-year statutory warranty of good working order; every dishwasher, washer and dryer five years; every television four; every desktop, laptop, tablet, phone and games console three.
The starting capital this week is CAD $707.25 (USD $500 at 1.4145, Bank of Canada, 25 September 2026) and the target is CAD $7,072.50 a month (USD $5,000). Almost none of the capital goes on knowledge or documentation, because Québec has already legislated the price of both to zero. It goes on registration, hand tools and a parts float.
Who is on the other side of the trade: Québec’s own regulatory impact analysis counts 56,940 retail businesses and 16,050 manufacturers inside the scope of these rules, and scored the whole package at “des coûts de 0 $ et des économies de 0 $” [costs of $0 and savings of $0]. That estimate assumes the repairs happen. Someone has to do them, and the Act gives the merchant ten days to name that person in writing.
The evidence
10 findingsThe durations are fixed in a regulation, not left to argument
New section 79.21 of the Règlement d’application de la Loi sur la protection du consommateur sets the garantie de bon fonctionnement at six years for “une cuisinière, un réfrigérateur, un congélateur, un climatiseur et une thermopompe” [a stove, a refrigerator, a freezer, an air conditioner and a heat pump], five years for “un lave-vaisselle, une machine à laver et un sèche-linge” [a dishwasher, a washing machine and a dryer], four for “un téléviseur” [a television] and three for “un ordinateur de bureau, un ordinateur portable, une tablette électronique, un téléphone cellulaire et une console de jeu vidéo”.
Section 8 of the regulation: “Le présent règlement entre en vigueur le 5 octobre 2026.” [This regulation comes into force on 5 October 2026.] Gazette officielle du Québec, Partie 2
The Act names the agent, not just the owner
“Aucun commerçant ou fabricant ne peut recourir à une technique ayant pour effet de rendre plus difficile pour le consommateur ou son mandataire d’entretenir ou de réparer un bien.” [No merchant or manufacturer may resort to a technique having the effect of making it more difficult for the consumer or their agent to maintain or repair a good.] Introduced by section 14 of the Loi protégeant les consommateurs contre l’obsolescence programmée (2023, c. 21, tabled by then justice minister Simon Jolin-Barrette, assented 5 October 2023); section 37 of that Act brought s. 227.0.3 into force two years later. 2023, chapter 21
Breaking the lock for someone else is lawful in Canada
Bill C-244, sponsored by Wilson Miao, MP for Richmond Centre, received royal assent on 7 November 2024. The new section reads: “Paragraph 41.1(1)(a) does not apply to a person who circumvents a technological protection measure for the sole purpose of maintaining or repairing a product, including any related diagnosing…”, and subsection (2) extends it to a person who does so for another person. The exception covers the act, not a trade in circumvention devices. (In the United States the same act still needs a triennial DMCA §1201 exemption.) Parliament of Canada, C-244, royal assent
The manuals are free and the toolkit is capped — by law
Section 39.3: a part or service must be made available “à un prix raisonnable”, but “un renseignement nécessaire à l’entretien ou à la réparation d’un bien… doit être disponible gratuitement lorsqu’il est accessible sur un support technologique” [information necessary to maintain or repair a good must be available free of charge when it is accessible on a technological medium]. Section 39: “Ces pièces de rechange doivent pouvoir être installées à l’aide d’outils couramment disponibles et sans causer de dommage irréversible au bien.” [Those replacement parts must be installable using commonly available tools and without causing irreversible damage to the good.] Office de la protection du consommateur
Ten days, then the merchant owns the problem
The merchant or manufacturer has ten days to tell the consumer in writing the timeframe in which it proposes to carry out the repair. Enforcement behind it, in force since 5 January 2025: administrative penalties of up to $1,750 per day for an individual and $3,500 per day for anyone else, and, for trading in a good with programmed obsolescence, fines up to $125,000 or 5% of worldwide revenue, doubled on repeat. What a completed appliance call bills in Montréal today
Posted rates: $119.99 service call including travel and diagnosis, plus $40 labour per job, three-month parts-and-labour warranty, $25 surcharge after 4pm. A completed appliance visit therefore bills CAD $159.99 in labour before parts. Published rate card

Above fifty dollars, the paperwork is the job
A written évaluation is mandatory before repairing a stove, fridge, freezer, dishwasher, washer or dryer where the work will exceed CAD $50. It binds both parties: the repairer cannot charge above it without fresh authorisation, and a consumer’s waiver of the estimate only counts if the consumer writes and signs it themselves. Forty-five calls a month clears the target
Capital: 500 × 1.4145 = CAD $707.25. Target: 5,000 × 1.4145 = CAD $7,072.50 a month. Labour per completed call: 119.99 + 40.00 = $159.99. Calls needed: 7,072.50 ÷ 159.99 = 44.21, so 45 calls → 45 × 159.99 = $7,199.55 = USD $5,089.82. Spread over 21 working days that is 2.14 calls a day.
Diagram coordinates: replace-exit is flat at $899.99; repair-exit is 159.99 + part. They are equal where part = 899.99 − 159.99 = $740.00. At the real board price of $420.02 the repair exit is 159.99 + 420.02 = $580.01, a saving to the merchant of 899.99 − 580.01 = $319.98. Capital left after registration: 707.25 − 41.00 = $666.25. Take the three-, four- and five-year classes. Leave the six
The six-year class in s. 79.21 — fridges, freezers, air conditioners, heat pumps — is refrigerant work and needs certification you cannot buy for $666. Washers, dryers, dishwashers, stoves, televisions, laptops, tablets, phones and consoles do not. That is still four of the five categories the regulation covers.
-
Demand the documentation you are owed, in writing, in French
Section 39.3 makes maintenance and repair information free where it is held on a technological medium, and the Act requires it in French. Write to each manufacturer whose machines you intend to work on and ask for service manuals, error-code tables and diagnostic software. This is the single largest cost item in every other country, and here it is a form letter.
manuals + diagnostic software = $0.00 -
Buy the tools the statute promises will be enough
Section 39 requires parts to be installable “à l’aide d’outils couramment disponibles”. That is a legal ceiling on your tooling budget: a multimeter, a clamp meter, a security-bit set, nut drivers, spudgers and a shop vacuum. Anything a manufacturer designs to need more than that is the thing s. 227.0.3 forbids.

Sell into the ten-day clock, not to the homeowner
The demand is not a consumer looking for a repairman. It is a store manager holding a written repair request with ten days to answer it, whose only other compliant exit is to hand over a new machine. Approach independent appliance retailers, buying groups and extended-warranty administrators with one line: a written same-week attendance quote at the posted Montréal rate.
$119.99 attend + $40.00 labour = $159.99 -
Template the written estimate before the first call
Above $50 of work the évaluation écrite is mandatory and binding: name and address of both parties, description of the appliance, nature and total price of the repair, date and validity period. Get this wrong and the repair is unenforceable; get it right once and it is a saved file.
-
Circumvent the lock, do not sell the key
Copyright Act s. 41.121 covers you when you defeat a technological protection measure to diagnose, maintain or repair a product, including when you do it for someone else. It does not authorise a trade in circumvention tools or services sold as such. Keep the capability inside the repair, and invoice the repair.
-
Be on the list before the first covered machine is sold
On 5 October 2026 the covered installed base is zero, and it compounds for five years. The technicians who are registered, insured and quoting in the first quarter are the ones who will be on the merchant’s speed-dial when the base is three years deep. Forty-five calls a month is the whole target.
7,072.50 ÷ 159.99 = 44.21 → 45 calls = USD $5,089.82
