A €150 door opens on a market whose smallest legal step is €441,000.

The arrêté du 11 mai 2026, in force since 1 June, prices an account on France’s national energy-savings-certificate register at « 150 euros » to open and « 150 euros pour chaque année civile entamée » [150 euros for each calendar year begun] thereafter. Article L.221-8 of the code de l’énergie makes the certificates « des biens meubles incorporels négociables » [negotiable intangible movable property] that may be held, acquired or sold « par toute autre personne morale » [by any other legal person]. In September 2026 the register logged 46,878 GWh cumac changing hands at €8.82 per MWh cumac — €413 million in one month, across 206 transactions. But article 8 of the arrêté du 29 décembre 2014 will not accept a dossier below 50 GWh cumac, and at that index 50 GWh cumac is €441,000.

Starting capital this week is €446.63 [$500], at the European Central Bank euro reference rate of EUR 1 = USD 1.1195 published for 14 October 2026. The target, about $5,000 a month, is €4,466 a month or €53,595 a year. Evidence figures below stay in the currency their source states them in; only the derived rows convert, and they show the rate.

What makes this week’s gap unusual is that the French state wrote down what it thought the entry ticket ought to cost, and then did not charge it. A draft article R.221-26 of the code de l’énergie would have required anyone opening a register account to hold « un capital social d’au moins 100 000 euros » [share capital of at least 100,000 euros]. Sénateur Hervé Maurey asked, in question écrite n° 06959 published 11 December 2025, why décret n° 2025-1048 du 30 octobre 2025 had dropped it. The ministry’s answer, published 21 May 2026, confirms that « cet article n’a finalement pas été retenu dans la version finale » [this article was ultimately not kept in the final version], and that « seules les personnes disposant d’un compte dans le registre peuvent acheter et vendre des CEE » [only persons holding an account in the register may buy and sell CEE].

So the gate is not priced in money. It is priced in quantity, and the quantity is fixed by arrêté rather than by the market: a dossier of 50 GWh cumac for standardised operations, 20 GWh cumac for specific ones. That is the real reading of this market. Everyone treats the CEE price as the interesting number; it moved from €8.48 to €8.82 across the whole of 2026, a range of four per cent. The scarce thing is not the certificate but the dossier — and the people on the other side of the trade, the obligated energy sellers and their délégataires, are buying assembled volume, not price.

One quantity, two thresholds. The rising line is simply holdings × price: at the Emmy weighted average of €8.82 per MWh cumac, one GWh cumac is €8,820, so the line runs from (0, €0) through (50 GWh cumac, 50,000 × €8.82 = €441,000) and leaves the top of the frame at 56.7 GWh cumac. The flat line is the year’s income target, €53,595. They cross at €53,595 ÷ €8,820 = 6.08 GWh cumac. That crossing sits far below the dashed marker at 50 GWh cumac, and the distance between the two is the whole finding: the smallest dossier the state will look at is worth 8.2 times a year’s target, so the constraint on a small holder is never how much the certificates sell for — it is assembling enough of them in one envelope to be allowed to ask.

The certificates may be held and sold by any legal person

The ministry’s own questions-réponses on the CEE scheme states that certificates « constituent des biens meubles incorporels négociables » [constitute negotiable intangible movable property] and that L.221-8 « dispose qu’ils peuvent être détenus, acquis ou cédés par toute personne mentionnée aux 1° à 6° de l’article L. 221-7 ou par toute autre personne morale » [provides that they may be held, acquired or transferred by any person mentioned in 1° to 6° of article L. 221-7 or by any other legal person]. There is no licence, no authorisation and no capital test in the holding right itself. Ministères Transition écologique, questions-réponses CEE.

The register’s whole price list is €150, €150, €2.30 and €4.10

In force since 1 June 2026 and repealing the arrêté du 20 juin 2024 from the same date: « Les frais d’ouverture de compte s’élèvent à 150 euros » [account opening fees amount to 150 euros]; « Les frais de gestion de compte s’élèvent à 150 euros pour chaque année civile entamée », not payable for the year in which the opening fee was paid; registration of delivered certificates at « 2,30 euros par million de kilowattheures d’énergie finale cumulée actualisés » [2.30 euros per million kWh cumac]; and transfers between account holders at €4.10 per million kWh cumac, paid by the acquirer. The 2024 schedule charged €2.20 and €2.80 for the same two acts. AIDA / INÉRIS, arrêté du 11/05/26.

Regulationquestion écrite n° 06959, Sénat · réponse du 21 mai 2026

A €100,000 capital requirement was drafted for this account, then dropped

Sénateur Hervé Maurey’s question, published 11 December 2025, records that a draft article R.221-26 would have conditioned the opening of a register account on not being in redressement or liquidation judiciaire and on holding « un capital social d’au moins 100 000 euros », and that décret n° 2025-1048 du 30 octobre 2025 — the sixth-period decree — « n’a pas retenu ces conditions ». The ministry’s reply confirms the article « n’a finalement pas été retenu dans la version finale », that such provisions fall to a décret simple, and that a replacement was before the Conseil supérieur de l’énergie on 16 April 2026. Regulationart. 8, arrêté du 29 décembre 2014 · art. R.221-5 code de l’énergie

The gate is a quantity: 50 GWh cumac a dossier, 1 TWh cumac a delegation

The DGEC doctrine sets out the minimum volumes of a demande: « 50 GWh cumac pour une demande portant sur des opérations standardisées ; 20 GWh cumac pour une demande portant sur des opérations spécifiques ; 20 GWh cumac pour une demande portant sur la contribution aux programmes ». One tier up, R.221-5 fixes the minimum partial delegation of an obligation at 1 TWh cumac. The same doctrine notes that the scheme runs on « silence vaut accord » — administrative silence on a complete dossier is acceptance, with a four-month withdrawal window and finality at six or ten months.

Regulator filingConseil d’État, ordonnance n° 515657 du 15 juin 2026

The ministry cancelled 6.3 TWh cumac from one account, and was suspended

By decision of 27 April 2026 the minister fined the société OFEE — capped at the statutory maximum — 5 224 968,60 euros, cancelled 4.34 TWh cumac classique and 1.96 TWh cumac précarité, ordered the shortfall bought back, and suspended its pending RES-CH-106 and RES-CH-107 applications. OFEE’s Emmy balance that day was 222,003,803 kWh cumac classique and 594,487,603 kWh cumac précarité. The juge des référés found « les risques sérieux pesant sur la viabilité économique de l’entreprise ainsi invoqués sont avérés » [the serious risks to the undertaking’s economic viability thus invoked are established] and suspended the sanction, with €3,000 costs against the State. Conseil d’État, n° 515657.

The state charges €115 to register the delivery of €441,000

At €8.82 per MWh cumac, one GWh cumac is €8,820, which fixes the rising line: (0, €0) to (50, 50,000 × €8.82 = €441,000), leaving the frame at €500,000 ÷ €8,820 = 56.69 GWh cumac. The flat line is €53,595, so they cross at 53,595 ÷ 8,820 = 6.08 GWh cumac, which is 6.08 ÷ 50 = 12.2% of one minimum dossier and 6.08 ÷ 46,878 = 0.013% of September’s traded volume. The arrêté’s delivery fee on that dossier is 50 × €2.30 = €115, a ratio to the value registered of €8,820 ÷ €2.30 = 3,835×. The delegation tier, 1,000 GWh cumac, is €8,820,000.

DerivedECB reference rate, 14 October 2026

The stake covers the door, the first dossier and the second year, with €31.63 left

At EUR 1 = USD 1.1195 (ECB euro reference rate, 14 October 2026), $500 = €446.63 and $5,000 a month = €4,466.28 a month, €53,595.36 a year. The arrêté du 11 mai 2026 charges €150 to open the account, €115 to register the delivery of a 50 GWh cumac dossier, and €150 of account management the following January: €415 in all, €31.63 short of the stake. Check on the income side: 6,076.57 MWh cumac × €8.82 = €53,595 ÷ 12 = €4,466.28 × 1.1195 = $5,000 a month.

The ladder

From $500 to $5,000 a month · €446 → €4,461

The statute does the work that people assume a licence has to do. L.221-8 lets « toute autre personne morale » hold, acquire and sell the certificates, and the registry restates it without qualification. Nothing in the holding right asks what you are worth.

  1. Be a legal person, and stop there

« Toute personne morale peut ouvrir un compte dans le Registre »
  2. Pay the door, which is a published tariff

Not a negotiation, not a membership, not a deposit — a ministerial order with four numbers in it. The stake covers the opening fee three times over, and the second year’s management fee is the same €150.

    €446.63 [$500] · opening €150 · management €150/yr from year two
  3. Read the fee schedule as a map of where the value is

A tariff written per million kilowatt-hours tells you what the administration thinks it is handling. It charges €2.30 to register the delivery of a quantity that sells for €8,820 — and €4.10, payable by the buyer, to move it. The paperwork is costed at four-hundredths of one per cent of the thing.

    50 GWh cumac · €115 to register · €441,000 registered · 3,835×
  4. Notice that the bar that was dropped was the money one

This is the rung most readings get backwards. The administration drafted a €100,000 capital test for the account and did not enact it, while leaving a 50 GWh cumac volume test for the dossier fully in force. It de-restricted the thing a small holder could never have bought and kept the thing a small holder cannot assemble alone.

    drafted €100,000 capital · enacted €150 fee · unchanged 50 GWh cumac
  5. Be the one who presents the dossier

The floor applies to the envelope, not to its author. The registry’s own FAQ spells out the move: a non-éligible who acts as tiers regroupeur for a number of obligés or éligibles becomes éligible, « car c’est lui qui présente la demande de certificats et se les fait attribuer » [because it is he who presents the application and has them attributed to him]. Aggregation is the product; the certificates are the receipt.

6.08 GWh cumac retained = 12.2% of one floor dossier = the whole year
  6. Price the revocation, and stay off the delegation tier

The asset can be cancelled after it is delivered, and the account is where the regulator reaches you: the OFEE sanction cancelled 6.3 TWh cumac and ordered the shortfall bought back on a market the holder does not control. Suspension came from the Conseil d’État, not the ministry. One tier up, partial delegation starts at 1 TWh cumac, which is not a step but a wall.

    1 TWh cumac = €8,820,000 · OFEE penalty €5,224,968.60
