Japan’s invoice cliff landed at 70% yesterday, not the legislated 50%.
The 2016 statute that built the invoice system said a buyer’s deduction on purchases from an unregistered supplier would fall from 80% to 50% on 1 October 2026. The FY2026 tax reform, agreed in Cabinet on 26 December 2025, extended the measure by two years and rewrote the ladder to 70 / 50 / 30 / 0. It took effect yesterday. For a sole proprietor billing ¥790,800 a month, the penalty for staying outside the system is now ¥1.20 per ¥100 of pre-tax price instead of the ¥3.24 the repealed text implied — a 62.8% cut to a number three years of commentary told people to fear. In the same reform a new 3割特例 appeared, available to individuals only, which hands every sole proprietor the 70% deemed-purchase rate of a manufacturer for 2027 and 2028 regardless of what they actually do.
The non-consensus reading: Japan is not squeezing small traders into the tax net. It is paying them to walk in. A registered individual on the 2割特例 keeps ¥108 of every ¥100 of standard price; an unregistered one, after the discount a rational buyer can now justify, keeps ¥106.80. The state funds the difference. That is why the ladder below starts with a free form rather than with capital — and why its ceiling is set by a statute, not by ambition.
The ceiling matters more than the floor. ¥790,800 a month is ¥9,489,600 a year, or 94.9% of the ¥10,000,000 base-period threshold in 消費税法第9条. Cross it and the 2割・3割特例 disappear two years later. The target is not “as much as possible.” It is ¥790,800 and not a yen more.
The evidence
8 findingsThe deduction ladder was rewritten to 70 / 50 / 30 / 0 and extended two years
「インボイス発行事業者以外の者からの課税仕入れについて、控除可能割合は令和8年10月から2年間70%、令和10年10月から2年間50%、令和12年10月から1年間30%となり、令和13年10月以降は0%」 [For taxable purchases from a person other than an invoice-issuing business, the deductible share is 70% for two years from October 2026, 50% for two years from October 2028, 30% for one year from October 2030, and 0% from October 2031.] The original text, 平成28年改正法附則第52・53条, set 80% to 30 September 2026 and 50% thereafter.
The 2割特例 survives the whole of 2026 for individuals — four filings, not three
「2割特例を適用できる期間は、令和5年10月1日から令和8年9月30日までの日の属する各課税期間となります。」 [The 2割特例 applies to each taxable period that contains a day between 1 October 2023 and 30 September 2026.] An individual’s taxable period is the calendar year, so the period containing 30 September 2026 runs to 31 December 2026. The NTA states the span as 「令和5年分(10月から12月分)の申告から令和8年分の申告までの計4回の申告」 [four filings in all, from the 2023 return covering October to December through the 2026 return].
A new 3割特例 for 2027 and 2028 — individuals only, corporations excluded
「個人事業者については、これまで2割特例の対象となっている個人事業者も含め、納税額を売上税額の3割とすることができる措置を2年に限り講ずる(令和9年及び令和10年分)」 [For individual proprietors, including those currently eligible for the 2割特例, a measure allowing tax payable to be set at 30% of output tax will be provided for two years only, for 2027 and 2028.] The NTA states the qualifying condition as 「個人事業者であること」 [being an individual proprietor]. A 合同会社 doing identical work gets nothing.
The 3割特例 is the 70% deemed-purchase rate of a manufacturer, handed to everyone
The simplified system’s deemed purchase rates are 90% (第1種, wholesale), 80% (第2種, retail), 70% (第3種, manufacturing), 60% (第4種), 50% (第5種, services) and 40% (第6種, real estate). Remitting 30% of output tax is arithmetically identical to a 70% deemed rate. A 第5種 translator or consultant therefore gains 20 percentage points from the new measure; a 第2種 retailer loses 10 and a 第1種 wholesaler loses 20. For those two the correct move is to refuse the 3割特例 and elect the simplified system instead.
The election is retroactive — a relief that barely exists elsewhere in the code
[A business that used the 2割 or 3割 special rule may obtain the simplified system for the following taxable period by filing the election by that period’s own filing deadline.] 消費税法第37条第1項 otherwise requires the election before the period begins. In practice a sole proprietor can decide how 2027 is taxed as late as 31 March 2028, with the year’s books already closed.
Buyers demanded a 10% cut for a problem worth 3%
The JFTC published five cautions, against an illustration-production firm dealing with illustrators, a processed-farm-goods maker dealing with farmers, a handmade-goods shop operator dealing with craft makers, a staffing agency dealing with translators and interpreters, and an e-manga distribution intermediary dealing with manga artists. The common conduct: 「インボイス制度の実施後も課税事業者に転換せず、免税事業者を選択する場合には、消費税相当額を取引価格から引き下げると一方的に通告した」 [unilaterally notified suppliers that if they chose to remain tax-exempt rather than register, an amount equal to the consumption tax would be cut from the transaction price]. The buyer’s real extra cost from an unregistered supplier is ¥3.00 per ¥100 of pre-tax price from 1 October 2026, and was ¥2.00 before it. The demand overshoots the injury by more than three times, which is the ground on which the JFTC treats it as abuse of superior bargaining position.
Year-one tooling for the whole ladder costs ¥0
やよいの青色申告 オンライン セルフプラン is listed at 「1年間無料」 for the first year and ¥11,800 plus tax a year after that; ベーシックプラン is ¥22,800 plus tax from year two, with the same product behind both. Every statutory step on this ladder — 開業届, 青色申告承認申請, 登録申請書 for invoice registration, 簡易課税制度選択届出書 — is filed free through e-Tax. The constraint on this route is a filing date, not capital.
¥1.20 now, ¥3.24 under the repealed text — a 62.8% cut
A buyer deducting a share d of the tax pays an unregistered supplier at most ¥110 ÷ (1.1 − 0.1d) in total, because at that price its net cost equals the ¥100 a registered supplier would cost it. d=0.8 → 110÷1.02 = ¥107.84. d=0.7 → 110÷1.03 = ¥106.80. d=0.5 → 110÷1.05 = ¥104.76. d=0.3 → 110÷1.07 = ¥102.80. A registered individual keeps 110 − 10×0.2 = ¥108.00 on the 2割特例, 110 − 10×0.3 = ¥107.00 on the 3割特例, 110 − 10×0.5 = ¥105.00 on 第5種 simplified. Gap today 108.00 − 106.80 = ¥1.20; under the repealed text 108.00 − 104.76 = ¥3.24; (3.24 − 1.20) ÷ 3.24 = 62.8%. Currency: $500 × 158.16 = ¥79,080; $5,000 × 158.16 = ¥790,800 a month, ×12 = ¥9,489,600, which is 9,489,600 ÷ 10,000,000 = 94.9% of the 消費税法第9条 threshold. Rate is the MUFG published TTM for 2 October 2026 ((159.16 + 157.16) ÷ 2).

Put the ¥79,080 where it is float, not spend
$500 at ¥158.16 is ¥79,080, which is exactly 10% of one month’s target billing — one month of consumption tax collected and not yet due. Year-one software is free. Hold the capital against the March remittance rather than spending it on tools.
¥79,080 = ¥790,800 × 10% -
Bill Japanese businesses direct, at ¥790,800 a month pre-tax
¥869,880 including tax. Direct B2B invoicing, not a freelance marketplace — the whole argument on this page is about three to five points of margin, and a platform take-rate is three to four times that. The buyer deducts the full ¥79,080, so your registration costs it nothing.
¥790,800 × 1.1 = ¥869,880/month -
Stop at the ceiling, deliberately
¥9,489,600 a year is 94.9% of the ¥10,000,000 base-period threshold in 消費税法第9条. Cross it in 2026 and you are a full taxpayer in 2028 with no 3割特例. The “$5,000 a month” target is not arbitrary here; it is the top of the subsidised band.
9,489,600 ÷ 10,000,000 = 94.9% -
Run 2割特例 to 31 December 2026
Remit 20% of output tax: ¥948,960 × 20% = ¥189,792 for the year, ¥15,816 a month set aside. You keep ¥108 on every ¥100 of standard price while the unregistered supplier down the street keeps ¥106.80.
¥948,960 × 0.2 = ¥189,792/yr -
Take the 3割特例 for 2027–2028 — unless you sell goods
30% of output tax is a 70% deemed rate. Service work (第5種, 50%) gains 20 points by taking it. Wholesale (第1種, 90%) and retail (第2種, 80%) lose by taking it and should elect the simplified system instead. Incorporating before 2029 forfeits the measure entirely: it is individuals only.
keep ¥107.00 vs ¥105.00 (第5種) vs ¥109.00 (第1種) -
Decide 2027 in March 2028, not in December 2026
The reform lets a 2割・3割特例 user file the 簡易課税制度選択届出書 by the filing deadline of the year it should apply to. Keep both options open, close the books, then pick. Almost nowhere else in 消費税法 can an election be made after the fact.

Price the 2029 step down before you reach it
From January 2029 the subsidy ends and service work keeps ¥105.00. The unregistered path keeps ¥104.76 until October 2030 and ¥100.00 from October 2031. That five-yen spread, not this month’s noise, is where the registration decision finally becomes irreversible.
105.00 − 100.00 = ¥5.00 from Oct 2031
