$500 idea · Pattern break · Germany · Edition 001
Germany just made €50,000 of federal money awardable with no tender and no notice.
On 1 July 2026 the Gesetz zur Beschleunigung der Vergabe öffentlicher Aufträge (BGBl. 2026 I Nr. 137, published 18 May 2026) lifted the federal Direktauftrag ceiling to €50,000 net. The baseline in § 14 UVgO is €1,000. That is a 50× move in eighteen months, and the second half of it matters more than the first: § 30 UVgO’s publication duty attaches to procedures — a restricted tender or a negotiated award — and a Direktauftrag is expressly not a procedure. The ceiling has now risen straight past the €25,000 line at which a contract would have had to be published. Between €25,000 and €50,000 there is now a band of federal spending that is neither competed nor recorded in public.
The consensus reading of the acceleration law is that it is about buyers: shorter lead times, fewer forms, a state that can finally order a laptop. That reading skips the side of the trade where the money actually lands. Below €50,000 there is no competitive price discovery at all — the price is whatever the Sachbearbeiter in the Vergabestelle accepts. The binding constraint on a supplier has stopped being “can you win a tender” (which needs references, a pre-qualification listing and someone to write the bid) and become “is your name in the buyer’s file”. That is a clerical barrier, not a competitive one, and clerical barriers are what €440 of capital is for.
§ 14 UVgO carries a second sentence that is usually read as housekeeping: „Der Auftraggeber soll zwischen den beauftragten Unternehmen wechseln.“ [The contracting authority should rotate between the firms it commissions.] It is a standing instruction to the buyer to give someone new a turn, with no procedure attached through which a newcomer could present itself. The rule creates the demand for new suppliers and supplies no mechanism for finding them. Nothing makes the buyer look for you.
The evidence
8 findingsThe baseline a German federal buyer could award without any procedure was €1,000
„Leistungen bis zu einem voraussichtlichen Auftragswert von 1 000 Euro ohne Umsatzsteuer können unter Berücksichtigung der Haushaltsgrundsätze der Wirtschaftlichkeit und Sparsamkeit ohne die Durchführung eines Vergabeverfahrens beschafft werden (Direktauftrag). Der Auftraggeber soll zwischen den beauftragten Unternehmen wechseln.“ [Services up to an anticipated contract value of 1,000 euros excluding VAT may be procured without carrying out a procurement procedure, having regard to the budgetary principles of economy and thrift (direct award). The contracting authority should rotate between the firms it commissions.] — § 14 UVgO.
The Vergabebeschleunigungsgesetz raised that ceiling to €50,000 net
The Umweltbundesamt’s own factsheet on the law states it plainly: „Danach können Leistungen bis zu einem voraussichtlichen Auftragswert von 50.000 EUR (ohne Umsatzsteuer) ohne die Durchführung eines Vergabeverfahrens als Direktauftrag beschafft werden.“ [Accordingly, services up to an anticipated contract value of EUR 50,000 excluding VAT may be procured as a direct award without carrying out a procurement procedure.] The Bundestag passed the bill on 23 April 2026 in the version amended by committee (BT-Drs. 21/1934, 21/5525); the federal ceiling applies to Bundesvergabestellen, with the Länder still on their own limits. — UBA factsheet, July 2026; Bundestag, 23 April 2026.
The interim step, effective 1 January 2026, was €15,000
„Abweichend von § 14 UVgO können Direktaufträge der Vergabestellen des Bundes bis zu einem Auftragswert von 15 000 Euro ohne Umsatzsteuer vergeben werden.“ [By way of derogation from § 14 UVgO, direct awards by federal contracting authorities may be made up to a contract value of 15,000 euros excluding VAT.] Announced in the Bundesanzeiger on 29 December 2025 and set to run to 31 December 2027 or until the acceleration law took over — which it did six months later. — Vergabeblog, 13 January 2026.
The publication duty names two procedures. The direct award is not one of them
„Der Auftraggeber informiert nach der Durchführung einer Beschränkten Ausschreibung ohne Teilnahmewettbewerb oder einer Verhandlungsvergabe ohne Teilnahmewettbewerb für die Dauer von drei Monaten über jeden so vergebenen Auftrag ab einem Auftragswert von 25 000 Euro ohne Umsatzsteuer auf seinen Internetseiten oder auf Internetportalen.“ [After carrying out a restricted tender without a call for competition or a negotiated award without a call for competition, the contracting authority shall publish, for three months, each contract so awarded from a contract value of 25,000 euros excluding VAT, on its websites or on internet portals.] The duty is triggered by the procedure, and it must name the winning firm. A Direktauftrag is defined in § 14 as procurement „ohne die Durchführung eines Vergabeverfahrens“ — so nothing in § 30 reaches it. — § 30 UVgO.
A named firm, a named building, €45,922.00, three years of cleaning
Optimax Gebäudeservice GmbH holds the Unterhaltsreinigung inkl. Fensterreinigung contract for the agency’s premises at Baringstraße 8, 30159 Hannover, awarded by Verhandlungsvergabe ohne Teilnahmewettbewerb, running 1 November 2024 to 31 October 2027 at a stated value of €45,922.00. This is a Land-level body, not a federal one — but the contract is the shape in question: routine, unglamorous, three years long, and €4,078 below the new federal ceiling. Awarded under the federal regime today it would need no procedure, and this notice would not exist. — Vergebene Aufträge, § 30 UVgO.
199,334 contracts, €135.2bn, and about 88% of them below the EU thresholds
The federal procurement statistics for 2024 — the highest readings since collection began in 2021 — record 199,334 reported contracts worth €135.2bn. Roughly 88% by count sat below the EU thresholds, i.e. in exactly the space the UVgO governs. 163,215 contracts (82%) and €56.3bn (46% of value) went to KMU. The statistics are aggregate and anonymised: they tell you the market exists, and nothing about who won what. — Vergabestatistik, Bericht für 2024; BMWE.
Standing up the supplier costs €26.00
Berlin’s official service listing for the Gewerbeanmeldung gives the fee as „26,00 Euro — je Einzel-Gewerbe, je Gesellschafter einer Personengesellschaft“ [26.00 euros — per sole trader business, per partner in a partnership], on the basis of the Verwaltungsgebührenordnung. Registration on the federal e-procurement platform and on individual Vergabestellen supplier lists carries no fee. — service.berlin.de, Gewerbe anmelden.
Three and a half contracts of that size clears the target
Currency, at the ECB euro reference rate for the US dollar on 29 September 2026: $500 ÷ 1.1355 = €440.33; $5,000 ÷ 1.1355 = €4,403.35 a month. Contract run-rate: €45,922.00 ÷ 36 months = €1,275.61 a month. Contracts needed: 4,403.35 ÷ 1,275.61 = 3.45, so four concurrently — €5,102.44 a month, or $5,793.83, on €183,688 of contract value, none of it tendered. Plot coordinates: ceiling steps at €1,000 / €15,000 / €50,000; notice line at €25,000; the dark band is 50,000 − 25,000 = €25,000 wide; the plotted contract sits 45,922 − 25,000 = €20,922 above the notice line and 50,000 − 45,922 = €4,078 below the ceiling. Capital left after registration: 440.33 − 26.00 = €414.33. — ECB euro reference exchange rates.
The ladder
From $500 to $5,000 a month · €439 → €4,394Gewerbeanmeldung under § 14 GewO at the district office. In Berlin the fee is €26.00 under the Verwaltungsgebührenordnung; other municipalities set their own in their Gebührensatzung, typically in the €20–€65 range. This is the only mandatory outlay on the whole rung.

€440.33 − €26.00 = €414.33 remaining -
Get into the files, not onto the portals
Register on the Bund’s e-procurement platform and on individual Vergabestellen supplier lists — both free. Note what this is for: a direct award is never published as an opportunity, so no portal will ever show it to you. Portal registration is table stakes; the supplier list is the actual asset.
-
Harvest the notices that still exist
§ 30 UVgO notices are published on buyers’ own websites for three months, and they name the winning firm, the subject, the period and often the value. They are the only public map of which German public bodies buy routine services without real competition. TU Braunschweig and the Klimaschutz- und Energieagentur Niedersachsen both run standing registers; hundreds of others do too. Read them as a prospect list, not as a tender feed.
-
Approach the buyer with the rotation sentence
The second sentence of § 14 UVgO instructs the buyer to rotate between the firms it commissions. It is the only part of German procurement law that works in a newcomer’s favour, and it is the reason an unsolicited approach to a Vergabestelle is not a nuisance but a compliance convenience. Ask to be in the file; name the service, the price and the availability.
-
Price each engagement as one contract under €50,000 net
The ceiling is per Auftragswert, estimated for the whole procurement. Splitting one requirement into slices to stay under the line is unlawful — the estimate under § 3 UVgO must cover the whole thing, and an artificial split is an evasion, not a technique. What is legitimate is taking work that genuinely is separate, and taking it repeatedly.
€45,922.00 ÷ 36 = €1,275.61 / month -
Stack to four running at once
Four contracts at the size of the Hannover cleaning award, overlapping, put €5,102.44 a month on the books — $5,793.83 at the 29 September reference rate, against a $5,000 target. The multi-year term is what makes the stack hold: the Hannover contract runs three years, so each win is thirty-six months of run-rate, not one invoice.
€4,403.35 ÷ €1,275.61 = 3.45 → 4 contracts -
Then, deliberately, leave the band
Above €50,000 the procedure comes back and the references you have accumulated below it become the thing you bid with. The band is an entry mechanism with a hard ceiling, not a destination: a firm that never crosses it has agreed to stay under €50,000 per contract for good.
