Nordrhein-Westfalen’s discounted group rate pays 2.4 times its full one-to-one rate.
§ 7 Abs. 4 of the Anerkennungs- und Förderungsverordnung caps what a recognised everyday-support provider may bill at €25 an hour one-to-one. Serve three or more entitled people in the same hour and the cap falls to €20 — charged against each person’s own benefit. Three at once is €60 an hour. Seven days ago, on 30 September 2026, the federal cabinet passed the Pflegeneuordnungsgesetz, which deletes the €131 Entlastungsbetrag at Pflegegrad 1 and routes its replacement, from Pflegegrad 2, to a Sozialraumbudget the health ministry’s own release says may be spent with „von den Pflegekassen anerkannte Einzelhelfende“ [individual helpers recognised by the care insurers].
The consensus reading of last week’s cabinet decision is that it is a cut. It is: 952,213 people at Pflegegrad 1 lose €131 a month, and the ministry’s own draft budgets the saving at €400m in 2027 rising to €500m by 2029. But a cut is a statement about who receives money, and the same documents make a separate statement about who may be paid it. The replacement budget is written around recognised providers, and the ministry names single recognised individuals in the same breath as agencies. The reform narrows the recipient list and widens the payee list at once.
The second half is the part nobody prices. Below the cap there is no price competition at all — § 7 Abs. 4 fixes the number, so a provider cannot be undercut and cannot charge more. What is left to compete on is whether a recognised provider exists within reach of the client, and that is a question of recognition, not of capital. In Nordrhein-Westfalen recognition is a 40-hour course under § 8 Abs. 3 and a decision by the Kreis or kreisfreie Stadt under § 19 Abs. 1. The €20 group rate was plainly drafted as a volume discount for the insurer. Read from the provider’s side it is a 20% price cut in exchange for a 3× multiple on the hour, and it is the only reason the arithmetic below closes.
The evidence
9 findingsThe price is fixed at €25 an hour, and at €20 when three are served at once
Where it is a group offering benefiting three or more entitled persons at the same time, the maximum billable amount is 20 euros per hour.] The billing runs against each entitled person’s own benefit, so the lower figure is a per-person price. — AnFöVO, MAGS NRW.
Signed this year by a named minister: Karl-Josef Laumann
The Neunte Verordnung zur Änderung der Anerkennungs- und Förderungsverordnung of 3 February 2026 amends the 2019 ordinance, dropping the written-form requirement in § 12 Abs. 1, inserting a new § 22 Abs. 2 on regional model projects for innovative support, and replacing the Bundesversicherungsamt with the Bundesamt für Soziale Sicherung. It is signed „Der Minister für Arbeit, Gesundheit und Soziales — Karl-Josef Laumann“. The current consolidated text is in force from 19 February 2026. — GV. NRW. 2026 S. 175; consolidated AnFöVO.
A single self-employed person is an eligible category, at 40 hours of class
§ 5 Nr. 3 names „Einzelkräften, die ihre Leistungen im Rahmen einer selbstständigen Tätigkeit oder eines unmittelbaren Beschäftigungsverhältnisses mit einer Person nach § 2 erbringen“ [individual workers providing their services as self-employed persons or in a direct employment relationship with a person under § 2]. § 8 Abs. 3: „Der Umfang der Schulung beträgt mindestens 40 Unterrichtsstunden.“ [The scope of the training is at least 40 teaching hours.] § 10 Abs. 2 requires a self-employed Einzelkraft who is not a Fachkraft to contract for professional guidance; § 7 Abs. 1 Nr. 3 requires liability cover. § 19 Abs. 1 puts the decision with the Kreise und kreisfreie Städte. — AnFöVO.
The cabinet draft deletes the benefit at Pflegegrad 1 outright
The government bill passed by cabinet on 30 September 2026 names „die Streichung der Leistung ‚Entlastungsbetrag nach § 45b SGB XI‘ in Pflegegrad 1“ [the deletion of the benefit ‘relief amount under § 45b SGB XI’ at care level 1] as a savings measure, under a heading of „präventionsorientierte Fokussierung der Leistungen bei Pflegegrad 1“. The June draft had proposed only half of it — see the row below. — Kabinett-GE PNOG.
The ministry priced the cut at €400m in 2027, €500m by 2029
The BMG’s own financial table lists „50%-Streichung der Leistung ‚Entlastungsbetrag nach § 45b SGB XI‘ im Pflegegrad 1“ [50% deletion of the benefit ‘relief amount under § 45b SGB XI’ at care level 1] at 400, 450, 500 and 500 million euros for 2027, 2028, 2029 and 2030. Between the 5 June working draft and the 30 September cabinet draft the measure hardened from a half cut to a full one; the published savings line still carries the half-cut wording. — RefE PNOG, 05.06.2026.
The replacement budget names recognised individuals, not just agencies
„Für die niedrigschwellige Unterstützung im Alltag wird anstelle des bisherigen Entlastungsbetrags in Zukunft ab Pflegegrad 2 ein Sozialraumbudget zur Verfügung gestellt.“ [For low-threshold everyday support, a social-space budget will in future be provided from care level 2 onwards in place of the previous relief amount.] On who may be paid from it: „Zu diesen zählen unter anderem auch von den Pflegekassen anerkannte Einzelhelfende, die als Nachbarschaftshilfe organisiert sind.“ [These include, among others, individual helpers recognised by the care insurers who are organised as neighbourhood help.] For claimants under 25 the budget is „bis zu 300 Euro im Monat, also bis zu 3.600 Euro im Jahr“. — BMG, 30.09.2026.
952,213 people at Pflegegrad 1, out of 6,011,267
The ministry’s 2025 figures for the soziale Pflegeversicherung: 952,213 beneficiaries at Pflegegrad 1, 15.8% of 6,011,267 in total, against expenditure of €73.82bn. The Entlastungsbetrag under § 45b SGB XI is listed as a „Leistungsbetrag von bis zu 131,00 Euro monatlich“ across all care levels. The ministry publishes no separate line for what is actually drawn down under § 45b. — BMG Zahlen und Fakten.
The 40-hour NRW qualification is on sale at €249
The listed product is Basisqualifikation § 45a/b SGB XI Nordrhein-Westfalen (AnFöVO) — Unterstützung im Alltag, 40 Unterrichtseinheiten, priced at €249 (from €299) as either distance learning or live virtual class, with open start dates and a stated completion time of about two weeks. The certificate additionally requires an in-person first-aid course. This is a seller’s own listing, not a regulator’s price. — Schulung AnFöVO.
The solo cap tops out below the target; three at a time clears it in 74 hours
Currency, at the ECB euro reference rate for the US dollar on 6 October 2026: $500 ÷ 1.1269 = €443.70; $5,000 ÷ 1.1269 = €4,436.95 a month. One-to-one ceiling: 160 hours × €25 = €4,000.00 = $4,507.60, short of the target with the month already full. Group rate: €20 × 3 = €60.00 an hour, and €4,436.95 ÷ 60 = 73.95 hours a month. Client count, since each client’s § 45b entitlement caps revenue at €131: 4,436.95 ÷ 131 = 33.87, so 34 clients — 34 × €131 = €4,454.00 = $5,019.21. Plot coordinates: solo slope 131 ÷ 25 = 5.24 h per client, group slope (131 ÷ 20) ÷ 3 = 2.18 h; the amber path meets 160 h at 160 ÷ 5.24 = 30.5 clients; at 34 clients the two paths read 178.2 h and 74.2 h. Capital left after the course: 443.70 − 249.00 = €194.70, which must still cover the first-aid course, the Gewerbeanmeldung and the first liability premium. — ECB euro reference exchange rates.
The ladder
From $500 to $5,000 a month · €447 → €4,473§ 8 Abs. 3 AnFöVO sets the qualification at 40 Unterrichtsstunden covering the nine content areas in § 8 Abs. 2. It is a course, not an exam, and it is the whole academic barrier. The listed NRW Basisqualifikation is €249; the certificate also wants an in-person first-aid course, which is why the remainder matters.

€443.70 − €249.00 = €194.70 remaining -
Apply to the district, not to a ministry
§ 19 Abs. 1 puts recognition with the Kreise und kreisfreie Städte, and § 20 lets them charge a fee for it. That means 53 separate decision-makers in NRW with 53 separate registers, and a provider recognised in one district is listed where clients of that district look. Pick the district first and the clients second, not the reverse.
-
Buy the two things the ordinance insists on
§ 7 Abs. 1 Nr. 3 requires liability cover for damage. § 10 Abs. 2 requires a self-employed Einzelkraft who is not a Fachkraft to contract for professional guidance — a standing relationship with someone qualified, not a one-off signature. Both are recurring costs and both are cheaper than being refused.
-
Do not try to win on price
§ 7 Abs. 4 fixes the number. You cannot undercut and you cannot charge more, and recognition is withdrawn from a provider who bills above it. Everything that would be competitive behaviour in an open market is either forbidden or pointless here. What remains is availability, and nobody is bidding for that.
€25.00 / h one-to-one · €20.00 / h each in threes -
Build the hour around three people, not one
The group rate needs „gleichzeitig drei oder mehr anspruchsberechtigten Personen“ — three or more entitled people at the same time. That is a scheduling problem and a geography problem, and it is the only real work on this ladder: three recognised clients who will accept the same hour in the same place. The reward is that the hour pays €60 instead of €25.
€20.00 × 3 = €60.00 / hour -
Count clients, not hours
Each client’s § 45b entitlement is €131 a month, so a client is worth €131 whatever you do, and the business is a client-count business with an hours constraint attached. Thirty-four clients is €4,454 a month, $5,019 at the 6 October rate. One-to-one that is 178 hours and therefore impossible; in threes it is 74.
34 × €131 = €4,454.00 / month · 74.2 hours -
Then watch the budget change shape, and move with it
The cabinet draft of 30 September replaces the €131 with a Sozialraumbudget from Pflegegrad 2 and deletes it at Pflegegrad 1. A business built on Pflegegrad 1 clients is a business with a legislated end date; one built on the recognition itself survives into whatever the Bundestag passes, because the recognition is what both the old benefit and the new budget are spent against.
